ORDINANCE No. 2,957, OF JULY 4, 2019

Disclose, in the form of Annexes I and II, the list of vessels that are authorized to resume their activities in mullet capture (Mugil liza), in the form of Siege/Traineira, to operate in the Southeast/South region, for the fishing season of 2019, referring to INTERLOCUTORY APPEAL No. 5023208-12.2019.4.04.0000/RS

THE AQUACULTURE AND FISHING SECRETARY OF THE MINISTRY OF AGRICULTURE, LIVESTOCK AND SUPPLY, in the use of its powers, grants it Provisional Measure No. 870, of January 1, 2019, in view of the provisions of Decree No. 9,667, of January 2 of 2019, in items I and X, of art. 3 of Law No. 11,959, of June 29, 2009, in Normative Instruction SEAP/PR No. 3, of May 12, 2004, in Interministerial Normative Instruction MPA-MMA No. 10, of June 10, 2011, in MAPA Normative Instruction No. 8 of May 8, 2019 and MAPA Normative Instruction No. 9, of May 8, 2019, CONSIDERING what is contained in INTERLOCUTORY APPEAL No. 5023208-12.2019.4.04.0000/RS, and in the records of the process no. 21000.030822/2019-11 and 00727.001045/2019-24:,

resolve:

Art. 1 To disclose, in the form of Annex I, the nominal list of fishing vessels that complied with the criteria established by INTERLOCUTORY APPEAL No. 5023208-12.2019.4.04.0000/RS, pending at the Federal Regional Court of the 4th Region of the Judiciary Branch, to resume the mullet capture activity in the form of Siege/Traineira, to operate in the Southeast/South region, for the 2019 fishing season.

Art. 2 To disclose, in the form of Annex II, the nominal list of fishing vessels that did not meet the criteria established by INTERLOCUTORY APPEAL No. 5023208-12.2019.4.04.0000/RS, pending at the Federal Regional Court of the 4th Region of the Judiciary Power , to resume the mullet capture activity in the form of Siege/Traineira, to operate in the Southeast/South region, for the 2019 fishing season.

Single paragraph. The vessels listed in Annex II of this Ordinance will have a period of 3 (three) business days to file an appeal regarding the pending issues, according to §1 of Art. 7 of MAPA Normative Instruction No. 09, of May 8, 2019.

Art. 3 This Ordinance enters into force on the date of its publication.
